1. USER INFORMATION

Who is responsible for processing your personal data?

UPEMUR, S.L.U., hereinafter the CONTROLLER, informs the USER that it has created a profile on the social networks Facebook, Instagram, Twitter, LinkedIn, YouTube, Vimeo and Google+, and that it is responsible for the processing of the user’s personal data carried out on these social networks, informing you that such data will be processed in accordance with Regulation (EU) 2016/679 of 27 April (GDPR) and Organic Law 3/2018 of 5 December (LOPDGDD), and providing you with the following information regarding the processing:

For what purpose do we process your personal data?

Purpose of processing: to maintain a relationship between the USER and the CONTROLLER, which may include the following operations:

  • To process requests and inquiries made to the controller
  • To provide information about activities and events organized by the controller
  • To provide information about products or services offered by the controller
  • To interact through official profiles

Why can we process your personal data?

Legal basis for processing: Article 6.1.a of the GDPR, the data subject has given consent for the processing of their personal data for one or more specific purposes.

The USER has a profile on the same social network and has decided to join the CONTROLLER’s social network, showing interest in the information published therein. Therefore, when requesting to follow our official profiles, the USER provides consent for the processing of the personal data published on their profile.

The USER may access the privacy policies of the social network at any time and configure their profile to ensure privacy.

The CONTROLLER has access to and processes the USER’s public information, especially their contact name. These data are only used within the social network itself and will only be incorporated into a file of the CONTROLLER when necessary to respond to the USER’s request.

How long will we retain your personal data?

Retention criteria: data will be retained as long as the USER does not withdraw the consent given, as indicated in this privacy policy.

To whom do we disclose your personal data?

Data disclosure: the information provided by the USER through the CONTROLLER’s social networks, including personal data, may be published, depending on the services used by the USER, and may therefore be publicly accessible to other users of the social networks.

From the profile of each social network, the USER may configure what information they wish to make public, review the permissions granted, remove them or disable them, as well as any third-party applications they no longer wish to use.

No disclosure of personal data to third parties outside the social network is foreseen, unless necessary for the development and execution of the purposes of processing, to our service providers related to communications, with whom the CONTROLLER has signed the confidentiality and data processing agreements required by current privacy regulations.

What are your rights?

The USER’s rights may only be exercised in relation to information under the control of the CONTROLLER:

  • The right to withdraw consent at any time
  • The right of access, rectification, portability and erasure of your data, as well as the right to restriction or objection to its processing
  • The right to lodge a complaint with the supervisory authority (www.aepd.es) if you consider that the processing does not comply with current regulations

2. USE OF THE PROFILE

The CONTROLLER will carry out the following actions:

  • Access to public profile information
  • Publication on the USER’s profile of any information already published on the CONTROLLER’s social network
  • Sending personal and individual messages through social network channels
  • Page status updates that will be published on the USER’s profile

The USER can always control their connections, remove content that no longer interests them, and define with whom they share their connections; for this purpose, they must access the privacy settings of their profile.

3. POSTS

Once the USER becomes a follower or joins the CONTROLLER’s social network, they may publish comments, links, images, photographs or any other type of multimedia content allowed by the social network. In all cases, the USER must be the owner of the published content, hold the copyright and intellectual property rights or have the consent of the affected third parties.

Any publication on the social network, whether text, graphics, photographs, videos, etc., that violates or may violate morality, ethics, good taste or decency, and/or infringes, violates or breaches intellectual or industrial property rights, the right to one’s own image or the law, is expressly prohibited.

In such cases, the CONTROLLER reserves the right to immediately remove the content without prior notice and may request the permanent blocking of the USER.

The CONTROLLER shall not be responsible for content freely published by a USER.

The USER must be aware that their publications will be known to other users, and therefore they are primarily responsible for their own privacy.

Images that may be published on the social network will not be stored in any file by the CONTROLLER, but they will remain on the social network.

4. DATA OF MINORS OR PERSONS WITH SPECIAL NEEDS

Access and registration through the CONTROLLER’s social networks are prohibited for minors under 14 years of age. Furthermore, if the USER has any type of disability, the intervention of the holder of parental authority or guardianship, or their legal representative, will be required through a valid document proving such representation.
